1. Acceptance of Terms
By accessing or using DAMAGED ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. We reserve the right to update these terms at any time; continued use constitutes acceptance of the changes.
2. Description of Service
DAMAGED is a SaaS platform that helps retailers file and track damage claims with wholesale suppliers. Features include AI-powered claim drafting, automated follow-ups, analytics, and recovery tracking. We grant you a non-exclusive, non-transferable license to use the Service in accordance with your chosen plan.
3. User Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must provide accurate information and notify us immediately of any unauthorized use. Accounts are for a single business entity unless otherwise specified in your plan.
4. Subscriptions & Billing
Plans billed monthly or annually as selected. Payments are processed securely via Stripe. You may cancel anytime — access continues until the end of the current billing period. No partial refunds. Prices are in Canadian dollars and may change with 30 days notice.
5. Free Trial
The 45-day free trial grants full Pro access. No credit card required. At the end of the trial, you must select a paid plan to continue. We reserve the right to limit or revoke trial access if we detect abuse.
6. Acceptable Use
You agree not to use the Service for any unlawful purpose, to submit false or misleading claims, to attempt to access another user's account, to reverse-engineer the platform, or to use automated tools in a way that abuses our infrastructure.
7. Data & Privacy
We take data protection seriously. Claim data, photos, and supplier information you submit remain yours. We do not sell your data. Our data handling practices are described in our Privacy Policy. We implement industry-standard security measures to protect your information.
8. Limitation of Liability
DAMAGED is provided 'as is' without warranties of any kind. We are not liable for any indirect, incidental, or consequential damages arising from your use of the Service, including but not limited to lost profits or missed claim recoveries. Our total liability is limited to the amount you paid in the 12 months preceding the claim.
9. Termination
We may suspend or terminate your access for violations of these terms, extended inactivity, or at your request. Upon termination, your data will be accessible for export for 30 days before permanent deletion.
10. Governing Law
These terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any disputes shall be resolved in the courts of Toronto, Ontario.
